They have to take it back...they will not give you a refund but they will exchange damaged opened DVD's, CD's, software, games etc. That is their policy here in Canada and I am sure it is the same "Over The Border" being that it is an American corporation. Go in with it and insist that they exchange it for a new one. They should do it with or without a receipt as well. Good Luck!!
